These Terms and Conditions ("Terms") govern your access to and use of our website and the purchase of products by licensed healthcare providers and medical organisations ("you", "your") from Rikimed Ltd ("we", "us", "our").

By accessing our site or placing an order, you confirm that you are a licensed medical provider or an authorised agent of one, and you agree to be bound by these Terms.

1. Eligibility and Professional Use

You represent and warrant that you are a licensed healthcare provider, medical practitioner, or an authorised purchaser for a healthcare organisation. Our products are not intended for general consumer use.

We reserve the right to request evidence of professional qualifications or institutional affiliation and may refuse or cancel orders if such verification is not provided.

2. Compliance with New Zealand Law

You are responsible for ensuring that all purchases and use of our products comply with applicable New Zealand laws, including:

  • Medicines Act 1981

  • Health and Disability Services (Safety) Act 2001

  • Fair Trading Act 1986

  • Consumer Guarantees Act 1993 (to the extent it applies to business transactions)

  • Privacy Act 2020

You acknowledge that some medical products may have use restrictions and require specific authorisation, training, or licensing.

3. Orders and Pricing

  • All orders are subject to availability and confirmation.

  • Prices listed are in NZD and inclusive of GST unless stated otherwise.

  • We reserve the right to change pricing or correct pricing errors at any time.

  • You may request a custom quote for bulk or recurring orders.

4. Payment Terms

  • Payment must be made via accepted methods (e.g. credit card, direct deposit/invoice, or approved purchase orders).

  • Invoices are due on the 20th of the following month unless otherwise agreed in writing.

  • Overdue accounts may incur late fees or collection costs.

5. Shipping and Delivery

  • Delivery times are estimates only and not guaranteed.

  • Risk of loss and title pass to you upon dispatch from our warehouse.

  • We deliver only within New Zealand unless special arrangements are made.

6. Returns and Refunds

  • Return requests must be submitted within 15 business days of receipt.

  • Certain items (e.g. sterile, perishable, special-order, or temperature-sensitive goods) are not returnable.

  • Returns may be subject to a restocking fee.

  • Goods must be returned unused, in original packaging, and in resalable condition.

7. Product Use Disclaimer

All products must be used only by appropriately trained and authorised personnel. We accept no liability for misuse, off-label use, or operation outside manufacturer instructions.

8. Warranty and Limitation of Liability

  • Products are sold with the warranties (if any) provided by the original manufacturer.

  • To the extent permitted by law, we exclude all other warranties, express or implied.

  • Under no circumstances shall our liability exceed the purchase price of the goods in question.

11. Purchase Agreement

Please see our standard Purchase Agreement. For clients with ongoing contracts or bulk supply arrangements, terms may also be governed by a separate Purchase Agreement. In case of conflict, that agreement shall prevail.

12. Force Majeure

We shall not be liable for any delay or failure to perform due to causes beyond our reasonable control, including but not limited to natural disasters, supply chain disruptions, labour disputes, or regulatory changes.

13. Governing Law and Disputes

These Terms are governed by the laws of New Zealand. Any disputes shall be resolved in the courts of New Zealand, unless otherwise agreed in writing.
